Terms & Conditions
Commission: £50 per new paying client.
Qualifying referral: new customer + paid purchase + tracked link/code + not refunded.
Holding period: 30 days.
We can reject applications and remove affiliates at any time.
You must disclose affiliate promotion and avoid medical claims.
Detailed Terms
Definitions
- Company means PEMFiT Ltd and any associated UK PEMFiT studios that participate in this affiliate programme.
- Affiliate means an individual or organisation approved by the Company to promote PEMFiT using a tracked link or code.
- Referral means a person who accesses PEMFiT through an Affiliate’s tracked link or code.
- Qualifying Referral means a Referral that meets all criteria set out in these terms.
- Commission means the £50 payment payable for each Qualifying Referral.
- Programme means the PEMFiT Affiliate Programme described on this page.
- Holding period means the 30-day period starting on the date the Referral completes a commission-eligible payment.
- Affiliate code means the unique code the Company provides to an Affiliate for use at checkout.
- Chargeback means a payment reversal by a bank, card issuer, or payment provider.
Application and acceptance
- Applying to the Programme does not guarantee acceptance.
- All affiliate applications are reviewed manually.
- The Company may accept or reject any application at its sole discretion.
- The Company is not required to give reasons for rejection.
- Approval may be withdrawn at any time if the Affiliate no longer meets Programme standards.
- Providing misleading or false information may result in rejection or removal.
- The Company may suspend an Affiliate or deactivate anAffiliate code at any time, including while it investigates suspected misuse or fraud.
Commission
- Affiliates earn £50 per Qualifying Referral.
- Commission is paid only for new customers who were not previously registered or paying PEMFiT clients.
- Commission rates may be changed in the future but will not apply retrospectively.
- VAT and invoicing: If an Affiliate is VAT registered, they must send the Company, or the relevant PEMFiT Studio, a valid VAT invoice for £50 + VAT for each Qualifying Referral. The Company will pay £50 + VAT against that invoice. If an Affiliate is not VAT registered, the Company will pay £50 per Qualifying Referral.
Qualifying referrals
- The referral must be a new customer to PEMFiT.
- The referral must complete a paid PEMFiT service designated as commission-eligible.
- The referral must be tracked using the Affiliate’s unique link or code.
- The referral must not cancel, refund, or reverse payment during the holding period.
- Self-referrals, duplicate accounts, or fraudulent sign-ups do not qualify.
- Holding period clarification: 30 days. The referral must not cancel, refund, reverse payment, or charge back during the holding period.
- New customer clarification: A new customer is a person who was not previously registered, booked, trialled, or paying with PEMFiT Ltd or any participating PEMFiT studio, under any email address or identity the Company reasonably links to the same person.
Tracking and attribution
- Tracking is based on links and referral codes provided to Affiliates.
- If tracking fails, commission may not be payable.
- The Company’s tracking decision is final.
- Code-based attribution rule: The code the person checks out with and pays with is the affiliate code that gets the commission.
- Only one affiliate code can apply per paid order. If a customer enters more than one code or changes codes, the code applied at the time of successful payment determines attribution.
- If a customer does not use an affiliate code at checkout, no commission is payable.
Marketing and brand rules
- Affiliates must promote PEMFiT responsibly and in good faith.
- Affiliates must not use spam, misleading messaging, or impersonate PEMFiT.
- Brand assets may only be used with Company approval.
- Paid search bidding on PEMFiT brand terms requires written permission.
- Disclosure requirements: The Affiliate must clearly disclose the affiliate relationship on each post, page, email, or message that promotes PEMFiT. The disclosure must be clear and placed so it is seen before a customer engages with the content (for example, at the start of a caption).
- Disclosure clarification: You must clearly label affiliate content as advertising before a customer engages with it (for example, “Ad”, “Advert”, or “Ad - Affiliate code”).
- Prohibited practices: The Affiliate must not use cookie stuffing, forced clicks, bots, click farms, misleading redirects, or similar methods. The Affiliate must not claim or imply they are an employee, agent, or official representative of PEMFiT.
- Voucher and deal sites: The Affiliate must not publish their affiliate code on voucher, coupon, or deal websites without the Company’s written permission.
- Removal requests: The Company may, at any time, require the Affiliate to edit or remove content. The Affiliate must comply within 24 hours of notice.
Wellness statements and testimonials policy
Limits to wellness statements and testimonials
- PEMFiT is a wellness service and not a medical treatment.
- Affiliates must not make diagnosis, treatment, cure, prevent, or guaranteed outcome claims about PEMFiT.
- Affiliates must not make pain-relief or guaranteed-result claims.
- General wellbeing language may be used, and results must be presented as a variable.
- Approved materials: The Affiliate must use only Company-approved claims, copy, images, videos, and testimonials. The Affiliate must not edit testimonials or add medical context to testimonials.
Safe Language Guidelines
You may say:
- “This supports general wellbeing and recovery.”
- “Some people report feeling more relaxed, energised, or recovered afterwards.”
- “This is a non-invasive wellness experience designed to support how you feel and function.”
- “Individual experiences vary and results are not guaranteed.”
You must not say:
- “This will diagnose, treat, cure, or prevent any disease or condition.”
- “This fixes pain / heals injury / reduces inflammation / reverses a condition.”
- “Guaranteed results” or “You will definitely feel X.”
- Any medical advice, diagnosis, or instruction to stop/change medication or treatment.
- Any claim that PEMFiT treats, relieves, reduces, or removes pain.
“The testimonials shared by PEMFiT clients on the PEMFiT website, YouTube, social media, and other platforms reflect their personal opinions and experiences and are not claims made by PEMFiT. Everyone’s body is different, individual results vary, and no outcomes are guaranteed. PEMFiT does not claim that any client’s experience is typical or representative of all users. We do not make any express or implied guarantees regarding specific results. PEMFiT testimonials should not be interpreted as medical, health, or performance advice.
PEMFiT provides non-invasive wellness services. PEMF at PEMFiT does not diagnose, treat, cure, or prevent any disease or condition. Individual experiences may vary. Always consult a healthcare professional before starting any new wellness practice.”
Payouts and tax
- Commission is paid monthly in arrears after the holding period.
- Payment is made by bank transfer or another approved method.
- Affiliates are responsible for declaring and paying any applicable tax on any Commissions they receive.
- Holding period reminder: 30 days. Commission will be calculated only after the holding period has ended for each Qualifying Referral.
- Payment administration: The Affiliate must provide valid bank details before payment. If the Affiliate is VAT registered, they must provide a VAT invoice for £50 + VAT for each Qualifying Referral before payment is made.
Termination and changes
- Either party may terminate participation at any time.
- The Company may withhold commission in cases of breach or misuse.
- Terms may be updated, and continued participation indicates acceptance.
- Effect of termination: If termination is for convenience and there is no breach, the Company will pay valid Commission already earned, subject to the holding period and these terms. If termination is due to breach, suspected fraud, or misuse, the Company may withhold any unpaid Commission and recover any Commission already paid for non-Qualifying Referrals.
Data Protection
- The Affiliate must not send the Company any Referral’s personal data (for example, name, email, phone number, address, or health information).
- The Affiliate must use only the tracked link or affiliate code to make referrals.
- The Affiliate is responsible for complying with applicable data protection and direct marketing rules for their own marketing activity.
Relationship of the parties
- The Affiliate acts as an independent contractor.
- Nothing in these terms creates an employment relationship, partnership, or agency.
- The Affiliate has no authority to bind the Company or make commitments on the Company’s behalf.
Intellectual Property
- The Company owns all brand assets.
- Brand assets may be used only with Company approval and only to promote PEMFiT under these terms.
- The Company may withdraw approval at any time, and the Affiliate must stop using brand assets on request.
Confidentiality
The Affiliate must keep non-public Programme information confidential. This includes tracking links, codes, reporting dashboards, and internal pricing or conversion data.
Liability
- The Programme is provided “as is”.
- The Company is not liable for indirect losses, loss of profit, loss of revenue, or loss of goodwill connected with the Programme.
- The Company’s total liability to the Affiliate under these terms is limited to the total Commission paid to the Affiliate in the 3 months before the event that caused the claim.
- Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be limited by law.
Indemnity
The Affiliate will indemnify the Company for losses, claims, and costs that arise from the Affiliate’s breach of these terms, unlawful marketing, or misleading claims.
Governing Law
- These terms are governed by the laws of England and Wales.
- The courts of England and Wales have exclusive jurisdiction.
Notices
- The Company may send notices by email to the address in the Affiliate’s application or account profile.
- The Affiliate may send notices to the Company using the contact details shown on the Programme page or the Company website.
